India Cracks Down on Deepfakes with New Regulations

After the meeting with social media companies on the issue of DeepFake, Union Communications, Electronics and IT Minister Ashwini Vaishnav has said that we all have agreed that we will soon come up with a clear and actionable law against DeepFake. All tech companies have said that deepfakes cannot be kept under free speech.

The minister said that deepfakes have emerged as a new threat to democracy. Vaishnav said, “Our next meeting will be held in the first week of December which will be based on today’s decisions. The next meeting will decide what should be included in the rules regulating deepfakes.


Let us tell you that in the last few days, many deepfake videos have gone viral, including the video of Sachin Tendulkar’s daughter and South actress Rashmika Mandanna. A deepfake video of Prime Minister Narendra Modi also went viral in which he was shown performing Garba.


What is deepfake?
Deepfakes can be both video and video. It is created using a special machine learning called deep learning. In deep learning, the computer is given two videos or photos and after seeing them, it automatically makes both the videos or photos the same. It is just like a child copying something.
Such photo videos have hidden layers that can be seen only through editing software. In one line, deepfake is a process of converting real images-videos into better real fake photos-videos. Deepfake photos and videos appear real despite being fake.

How are deepfakes made?
Deepfakes are created with the help of two networks, one is an encoder and the other is a decoder network. The encoder network analyzes the source content (the original video) and then sends the data to the decoder network. After that the final output comes out which is exactly like the original but in reality it is fake. All it takes is a video or videos. There are many websites and apps for deepfakes where people are creating deepfake videos. You look at the picture above. Neither this Instagram account belongs to Aishwarya Rai Bachchan nor the content shared on it belongs to Aishwarya Rai. This is the biggest example of deepfake.

How to recognize deepfake videos?
It is not easy to identify such photo-videos but it is not impossible either. To identify them you will have to watch the video very closely. Special attention has to be paid to facial expression, eye movement and body style. Apart from this, you can also identify them by their body colour. Usually in such videos the color of the face and body does not match. Apart from this, such videos can also be identified through lip syncing. You can also identify such videos by location and extra brightness. Apart from this, you can also decide by your own understanding whether this video is real or not. For example, the video of Barack Obama dancing on Bhojpuri song may be fake.

Punishment for making deepfake video
If you make and share deepfake videos of someone jokingly, then action can be taken against you under IPC section. Heavy fines can also be imposed. Apart from this, if someone’s image gets tarnished then a case of defamation will also be filed against you. In this case, action can also be taken against social media companies under IT rules. After the complaint, social media companies will have to remove such content from their platforms within 36 hours.
